Some people buy these products to make money and, in fact, make no money. Some people may buy these products and never read it or attempt to implement any of the moneymaking ideas. Some folks may seemingly take to it like a duck to water and can't stop making money. Nothing promoted on this website should be construed as a 'Get rich quick' scheme. Any income and earnings statements tend to reflect the more successful cases and you should not construe this as being the 'average' or usual success story. As is true in much of life, real success usually requires real work. Learning about products and product marketing is not terrible work and it can produce very livable income if a person is willing to learn his or her craft and work at it steadily. Even part-time efforts may bring in some extra money each month. But it requires learning skills that each individual may not have a background to easily learn and will certainly require constant education and, perhaps, even psychological motivation to keep you directed towards your goals.

According to the FTC information, here are a few important details concerning a Business Opportunity, Sellers Disclosure Obligations, Earnings Claims, Legal Actions, Cancel Policy and References.

I. Business Opportunity Rule

Under the proposed Business Opportunity Rule, a business opportunity exists whenever:

a. There is a solicitation to enter into a new business. This definition was intended to exclude current business to business sellers. However the FTC implies that offering new product lines or alternative merchandise to an existing business is considered a solicitation for a new business.

b. The buyer makes a payment to the seller in cash; check or any kind of installment sale agreement; and

c. The seller either:

(1) Makes an earnings claim; or

(2) Represents that some type of business assistance will be provided to the purchaser. Business assistance means the offer of material advice, information or support to a prospective purchaser. The guideline also establishes the following as business assistance:

1. providing locations/customer accounts

2. the promise that the business opportunity seller will buy the production from the business opportunity buyer; and

3. paying commissions based on the purchaser’s product sales or recruitment efforts.



II. Seller’s Disclosure Obligations

The FTC believes there are four critical areas to consider when a consumer makes a business opportunity purchase.

1. Earnings claims

A company is to provide an Earnings Claim Statement about any implied level of sales, income or profit the buyer can make or other purchasers have made. Earnings claims include the following:

o The name of the person making the claim
o The date of the earnings claim
o The beginning and ending dates when the represented earnings were achieved;
o The number and percentage of all purchasers during the stated time period who achieved at least the stated level of earnings;
o Any characteristics of the purchasers who achieved at least the represented level of earnings; and
o A statement that written substantiation for the earnings claim will be made available to the prospective customer/client upon request.


It is for this reason, we do not typically quote or make specific income claims. Again, we do not want to unfairly entice someone to get started in our business who would be swayed by a rare example of someone earning a huge substantial income. This business takes work and effort like any business. We also like to downsell the impact of our program and don’t want to risk misleading a client in any way.

We don’t have a way to officially track what someone spends overall on their advertising or for their business. The bottom line in any business is not what you take in as far as revenue (gross sales), it’s the actual amount left over (net profit) that is one of the main indicators of financial success in business.

We can not possibly do the accounting for thousands of clients and therefore as a guideline do not used exaggerated or high income claims. We don’t want to risk misleading you in any way. Instead we will offer you all the support we can offer to help with questions you may have, however again, please know that you’re results are your responsibility.

In certain cases where we use testimonials, they are true results to give you an understanding of how it may work for you. It’s a theoretical example to show you how IF you did X, it could produce Y. Although over 51% of our initial clients (effective May 1st, 2006) receive checks from our company, for the sake of the legal requirements we will state that less than 1% of our clients earn any substantial money. In no way does it reflect what could happen to you.

2. Legal Actions – The guideline states that we must disclose any civil lawsuits or criminal actions involving misrepresentation, fraud, securities law violations, or unfair or deceptive practice within the past 10 years.

We are proud to say that none of the key personnel in our company have had any type of civil lawsuits, criminal actions, misrepresentation, fraud, securities law violations or unfair or deceptive practices at any time in the last 10 years and as you can see by the above policies, we adhere to the policies in our industry.

3. Cancellation or Refund Policy – The guideline states that we must provide a statement describing the refund policy. Please see the section relating our refund and cancellation policy.

4. References – A new proposed guideline in the works right now states that a company classified under the Business Opportunity Rule must provide at least 10 purchaser references located nearest to the buyer. Information must include name, address and telephone number so the prospective buyer can contact those individuals to verify the sellers claims. It does not apply in our company, however the guideline also states that if there are fewer than 10 purchasers, the seller must provide information on all.

For this reason our company is being proactive in giving access to all types of people and their comments with our program. Some will ask that there contact information be left confidential as I think this is a smart idea because it could lead to serious solicitation issues.

RETURN POLICY

Maximum Response Marketing, Inc. values our relationship with you and offers a return policy as stated in our terms and conditions and disclosed to you at the time of purchase. Under this policy, you may return to Maximum Response Marketing, Inc., according to the applicable return policy period, products that you purchased directly through Maximum Response Marketing, Inc. for a credit or a refund of the purchase price paid, less shipping and handling (and if appropriate, restocking fees).

Restocking Fees: A standard restocking fee of up to 15% may be charged unless otherwise noted in our policies.

How to Return: To return products, you must contact Maximum Response Marketing, Inc. in writing at: 19322 107th Ave. NE; Arlington, WA 98223. Allow up to 2 business days for a response and receive a Return Merchandise Authorization Number within the return policy period applicable to the product you want to return.

You must ship the products to Maximum Response Marketing, Inc. at our mailing address. You must:

• Ship back all product you are seeking to return to Maximum Response Marketing, Inc. and only those products covered under the return policy. At Maximum Response Marketing, Inc’s discretion, credit for partial returns may be less than the invoice due to bundled or promotional pricing and any unadvertised discounts or concessions.

• Return the products in as-new condition with all media, documentation, and all other items that were included in the original shipment.

• Ship the product(s) at your expense, and insure the shipment or accept the risk of loss or damage during shipment. We recommend you ship in any manner that provides tracking (i.e. certified/return receipt requested, UPS, FedEx etc.)

Under receipt of the complete returned purchase, Maximum Response Marketing, Inc. will issue a credit or refund of the purchase price paid, less our shipping and handling and applicable restocking fees. You will see this credit or refund by the next billing statement.

CREDIT CARD DISPUTES

Maximum Response Marketing, Inc. offers refunds according to our stated policies. Likewise, we do not offer refunds other than those stated in our policies.

IMPORTANT INFORMATION ABOUT CREDIT CARD DISPUTES:

BEFORE INITIATING A CREDIT CARD CHARGE BACK, PLEASE CALL US AT 360-435-4508 TO AVOID INCURRING CHARGE BACK FEES. You may call us between 9am to 5 pm PST, Monday through Friday. Please allow us 3 business days to research and respond to your claim.

Maximum Response Marketing, Inc. will always institute the appropriate civil or criminal proceedings to reclaim the debt when a customer uses a credit card chargeback procedure fraudulently or to avoid payment of a legitimate debt. If the customer makes a chargeback without legal justification, a charge of $300.00 will be added to the total invoice amount to recover the outstanding administration charge as well as to collect the fee charged by our merchant suppliers who issued the chargeback. An invalid or unjustified chargeback will result in Maximum Response Marketing, Inc. reporting the invalid or unjustified chargeback to ChargebackProtection.org which may ban you from placing orders with any business that uses ChargebackProtection.org. If the customer does not pay the entire balance within 7 days of written notice to pay the outstanding balance, Maximum Response Marketing, Inc. will pursue its legal remedies to recover the debt owed, including reasonable attorney’s fees and costs.

Charge back rebuttals require at least 3 hours of preparation and mailing, transmission charges and other administrative costs. That is why you will be charged $300 for processing the chargeback. It is our policy to pursue our legal remedies even if we are unsuccessful on the chargeback rebuttal. If it is necessary to file a civil action against you for non payment of the product or services received, please note that we will seek recovery of the cost of the product or services, the chargeback fee of $300 for processing the chargeback, plus the cost of financial services charged to us caused by the chargeback.

Customer agrees that prior to initiating any chargeback procedure, customer will first contact Maximum Response Marketing, Inc. in an attempt to resolve the matter at issue. If a chargeback is made by the customer and such chargeback lacks any legal justification or is found to be invalid, customer agrees to pay an administrative fee of $300.00 to the balance total amount due and owing on the purchase. Customer agrees to pay this administration charge in addition to the $20.00 fee charged by the merchant supplier, bank, card issuer or any other entity to issue a chargeback. Customer further agrees to pay reasonable attorney’s fees and costs associated with collection of the debt.

Limitation of Liability Maximum Response Marketing, Inc. shall not be liable for any indirect or consequential loss or damage, whether for loss of profit, loss of business, depletion of goodwill or otherwise, howsoever caused, which arise out of or in connection with any contractor and or supply of goods or services by Maximum Response Marketing, Inc.

Maximum Response Marketing, Inc. shall not be liable for any financial consequence indirect or other losses suffered by the customer or any third party whether such loss arises in contract or any other way.

Duty to Defend and Indemnify Maximum Response Marketing, Inc. Customer expressly agrees as a term of service, customer agrees to step forward and defend Maximum Response Marketing, Inc. in the event that a lawsuit initiated against Maximum Response Marketing, Inc. arising from the active or passive negligence of the customer in the use, publication or distribution of materials and services provided to customer by Maximum Response Marketing, Inc.
